2022 INSTAGRAM LAUNCH CONTEST (THE “CONTEST”)
OFFICIAL CONTEST RULES & REGULATIONS (THE “CONTEST RULES”)
THE CONTEST IS CONDUCTED IN THE PROVINCE OF ONTARIO ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. PARTICIPANTS MUST MEET ELIGIBILITY REQUIREMENTS DESCRIBED HEREIN. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THE CONTESTS CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES.
By entering this Contest, you agree to abide by these Official Contest Rules and Regulations and the decisions of Educators Financial Group (“Sponsor“), which are final and binding.
To be eligible for the Contest, a person must (1) be a resident of Ontario or British Columbia, (2) have reached the age of majority in their province of residence and (3) not be an employee, representative or agent of, or domiciled with an employee, representative or agent of, Educators, its affiliates, marketing, and advertising agencies, suppliers or Contest judges.
The Contest runs from April 7, 2022 at 12:00 am (ET) to April 28, 2022 at 11:59 pm (ET) (the “Contest Period“).
There is no purchase necessary to enter or win. A purchase will not increase your chances of winning.
To enter this Contest, during the Contest Period, eligible participants must read and accept the OFFICIAL CONTEST RULES, have an Instagram Account to follow the guidelines detailed in the @educatorsfg in-feed post. Participants must be following the @educatorsfg Instagram Account. Participants must “like” the contest photo post on the @educatorsfg account. Lastly, participants must tag a friend in the comments section on the @educatorsfg post to qualify as one entry.
The Sponsor is not responsible for: (i) the incorrect or inaccurate capture of entry information and entries that fail to comply with the Contest Rules; or (ii) any problems or technical malfunctions of any telephone network or lines, computer online systems or servers, computer software problems or traffic congestion on the Internet or at any website, and assumes no liability for damage to entrant’s or any person’s computer or other device resulting from participating in the Contest.
A total of three (3) prizes are available to be awarded (each a “Prize”, and collectively, the “Prizes”) (total approximate retail value (“ARV”) of all Prizes is $300). Each winner will receive one (1) Indigo.ca gift card awarded in the amount of one hundred dollars ($100).
The Prizes and their components must be accepted as awarded and cannot be transferred, substituted, or exchanged, in whole or in part, for another prize or for money, unless otherwise agreed to by the Sponsor. Sponsor reserves the right to substitute a Prize by a prize of equivalent or greater monetary value if Sponsor is unable to award any Prize as described in the present Rules. All Entries are subject to verification. Sponsor reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to Sponsor) to participate in this Contest. Failure to provide such proof in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).
The Contest Sponsor makes no representation nor offers any warranty, express or implied, as to the quality or fitness of any prize awarded in connection with the Contest. Prize winners understand and acknowledge that he or she may not seek reimbursement or pursue any legal or equitable remedy from the Contest Sponsors should a prize fail to be fit for its purpose or is in any way unsatisfactory to a prize winner.
A random draw will be conducted on April 29, 2022 at or about 10:00 am (ET) from all eligible Entries received during the Contest Period. There will be three (3) Entries randomly chosen to be eligible to win a Prize. The odds of an Entry being drawn depend on the total number of eligible Entries received during the Contest Period. Limit of one (1) Prize per entrant.
Attempts to notify potential winners will be made using Instagram accounts provided at entry. Sponsor will direct message winners within 2 days after the draw. Sponsor is not responsible for phone, e-mail or other communication problems of any kind. If, despite reasonable efforts, a potential winner does not respond within 4 days of the first notification attempt (or such shorter time as exigencies may require), or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected.
Before being declared a winner, entrant must (1) correctly answer, without assistance of any kind, whether mechanical or otherwise, the mathematical skill-testing question posed by Sponsor and (2) sign the Sponsor’s Declaration and Release Form (the “Release Form”), which (among other things): (i) confirms compliance with these Rules and acceptance of the applicable Prize as awarded without substitution; (ii) releases Educators Financial Group and Ontario Secondary School Teachers Federation, their affiliates and advertising and promotions agencies, and each of their respective employees, officers, shareholders, representatives, directors and agents (collectively ‘Releasees’) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iii) agrees to the publication, reproduction and/or other use of his/her name, Instagram username, address, voice, statements and/or photograph or other likeness, without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet.
In the event that the selected entrant cannot be reached and has not responded within 4 days of the Random Draw Date, or if the selected entrant does not correctly answer the mathematical skill-testing question or the selected entrant does not complete the requested information or the selected entrant is otherwise ineligible, another entrant will be randomly selected and the process above will be repeated until such time as a winner is declared. If by 11:59 pm EST on May 31, 2022, no winner has been declared, then the Contest will be closed and no further Prizes will be awarded. Confirmed Winners must claim their prize no later than May 31, 2022, failing which, the Winner will be disqualified, will have forfeited their prize, and will have no claim to any prize nor any recourse towards the Sponsor, or any party involved in the Contest and the Prize will not be awarded.
The Sponsor shall not assume any liability for lost, misdirected, delayed or destroyed prizes while in transit from the Sponsors’ premises.
The terms by which the gift cards or gift certificates may be redeemed are governed by the applicable retailer or service provider. Sponsor is not responsible for administering or ensuring compliance with the terms and conditions of the gift cards or gift certificates.
Personal data gathered by Educators Financial Group will be used to administer this Contest. No further informational or marketing communications will be received by entrants unless entrants provide explicit permission to do so as indicated on the entry form. Sponsor reserves the right, at Sponsor’s sole discretion, to cancel, terminate, modify or suspend the Contest, in whole or in part, without notice or obligation.
Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with, or attempts to tamper with, the entry process or violates any of the Contest Rules. Any attempt to undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right, in its sole discretion, to seek damages or other remedies from any such person(s) responsible to the fullest extent permitted by law.
All decisions rendered by the Sponsor and/or its authorized representatives regarding any aspects of the Contest are final. This Contest is subject to all applicable federal, provincial and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
This Contest is in no way sponsored, endorsed or administered by any social media platforms on which the Contest may have been promoted and/or publicized, including but not limited to Instagram. You understand that by participating in the Contest you are providing your information to Educators Financial Group and not to Instagram (except as otherwise specified in the Instagram platform terms). You agree to completely release Instagram of all liability in connection with this Contest. Any questions or comments regarding a Contest must be directed to Educators Financial Group and not to any of the social media platforms on which the Contest may have been advertised or administered.
