2021 EDUCATION WEEK CONTEST (THE “CONTEST”)
OFFICIAL CONTEST RULES & REGULATIONS (“RULES”)

THE CONTEST IS CONDUCTED IN THE PROVINCE OF ONTARIO ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. PARTICIPANTS MUST MEET ELIGIBILITY REQUIREMENTS DESCRIBED HEREIN. VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THE CONTESTS CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES.

1. ELIGIBILITY

To be eligible for the Contest, a person must (1) be a resident of Ontario or British Columbia, (2) have reached the age of majority in their province of residence and (3) not be an employee, representative or agent of, or domiciled with an employee, representative or agent of, Educators, its affiliates, marketing, and advertising agencies, suppliers or Contest judges. A member of the education community is someone who is employed by an educational institution in Ontario or British Columbia. This offer cannot be combined with any other offers.

2. CONTEST PERIOD

The Contest runs from May 3, 2021 at 12:00 am (ET) to May 7, 2021 at 11:59 pm (ET) (the “Contest Period“). In order to be eligible for the Prize, each entry, regardless of method of entry, must be received during the Contest Period.

3. HOW TO ENTER

There is no purchase necessary to enter or win. A purchase will not increase your chances of winning. Void where prohibited.

A valid email address and, as applicable, a Facebook and/or Twitter account required. An account can be created for free at www.facebook.com and/or www.twitter.com. If you are entering the Contest through Twitter, your account privacy settings must have the “Protect Your Tweets” account setting options set to “OFF”.

To enter a Contest, during the Contest Period, follow the Contest Requirements on the Contest post(s) (each a “Contest Post” and collectively, the “Contest Posts”) found on Educators Financial Group’s social media pages.

Where the Contest Requirements instruct entrants to submit a comment or response on the Contest Post (each a “Response”), the Response must: (i) be written in English or French; (ii) satisfy all applicable instructions provided in the Contest Requirements; (iii) be posted as a comment on the relevant Contest Post on the applicable Educators Financial Group social media page(s); (iv) comply with these Rules as well as the applicable terms, rules, policies and guidelines of Facebook (the “Facebook Rules”) and/or Twitter (the “Twitter Rules”) all as determined by the Sponsor in its sole discretion. By submitting a Response, you will receive one (1) entry into the Contest (each an “Entry” and collectively, the “Entries”). Any Response that does not comply with these Rules and/or the applicable Facebook Rules and/or Twitter Rules will be deemed ineligible and will not entitle the individual to an Entry in the Contest.

Limit of one (1) entry per person per Contest Period, unless otherwise indicated. In the case of multiple entries, only the first eligible entry will be considered and the remainder will be void.

By participating in the Contest, each entrant hereby warrants and represents that any Response he/she submits: (a) is original to him/her and that the entrant has obtained all necessary rights in and to the Response for the purposes of entering such Response in the Contest; (b) does not violate any law, statute, ordinance or regulation; (c) does not contain any reference to or likeness of any identifiable third parties; (d) will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and (e) is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, include, discuss or involve, without limitation, any of the following: (i) nudity; alcohol/drug consumption or smoking; (ii) explicit or graphic sexual activity, or sexual innuendo; (iii) crude, vulgar or offensive language and/or symbols; (iv) derogatory characterizations of any ethnic, racial, sexual, religious or other groups; (v) content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; (vi) the personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); (vii) commercial messages, comparisons or solicitations for products or services other than the Sponsor; (viii) any identifiable trade-marks and/or brand names (other than those of the Sponsor); (ix) conduct or other activities in violation of these Rules; and/or (x) any other materials that are or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole discretion.

The Sponsor, its promotional agency and/or a content moderator designated by the Sponsor (the “Reviewer”) reserves the right to screen all Responses. Any Response that the Reviewer deems, in its sole discretion, to violate these Rules, the Facebook Rules and/or the Twitter Rules are subject to disqualification. The Reviewer reserves the right, in its sole discretion, at any time and for any reason, to hide/delete a Response with or without prior notification to the entrant and/or request an entrant to modify, edit and/or re-submit his or her Response in order to ensure that the Response complies with these Rules, the Facebook Rules and/or the Twitter Rules, or for any other reason. If such an action is necessary at any point during or after the Contest, then the Sponsor reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying the Response (and therefore the corresponding Entry/Prize, if any, and/or the associated entrant) – to ensure that the Contest is being conducted in accordance with the letter and spirit of these Rules.

The entrant must submit each Entry personally. The entrant may only use one (1) Facebook and/or Twitter account in connection with the Contest. Sponsor is not responsible for lost, late, undelivered, invalid, unintelligible, incomplete, misdirected, illegible, or damaged Entries, which will be disqualified. Entries become the exclusive property of Sponsor and will not be returned or acknowledged. Without limiting the generality of the foregoing, if a Facebook or Twitter account used to enter the Contest is closed before the deadline specified in the Contest Requirements, or before the entrant is contacted by the Sponsor to receive a Prize, any Entries made by that entrant via the closed account will be deemed ineligible and will not entitle the individual to an Entry.

Any attempt by any entrant to obtain more than the stated number of Entries by using multiple email addresses, social media accounts, identities, registrations and logins, or any other methods will void that entrant’s Entries and that entrant may be disqualified at Sponsor’s sole discretion. Use of any automated system (including but not limited to, Entries submitted using any robot, script, macro, or other automated service) to participate is prohibited and will result in the disqualification of the entrant. In the event of a dispute as to the identity of any person who submitted an Entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned to a social media account by a provider, service provider or other organization responsible for assigning the account for the email address. Potential winners may be required to show proof of being the authorized account holder.

4. PRIZES

A total of three (3) prizes are available to be awarded (each a “Prize”, and collectively, the “Prizes”) (total approximate retail value (“ARV”) of all Prizes is $150). Each winner will receive one (1) Well.ca gift card awarded in the amount of fifty dollars ($50).

The Prizes and their components must be accepted as awarded and cannot be transferred, substituted, or exchanged, in whole or in part, for another prize or for money, unless otherwise agreed to by the Sponsor. Sponsor reserves the right to substitute a Prize by a prize of equivalent or greater monetary value if Sponsor is unable to award any Prize as described in the present Rules.

5. PRIZE DRAW

A random draw will be conducted on May 10, 2021 at or about 10:00 am (ET) from all eligible Entries received during the Contest Period. There will be three (3) Entries randomly chosen to be eligible to win a Prize. The odds of an Entry being drawn depend on the total number of eligible Entries received during the Contest Period. Limit of one (1) Prize per entrant.

6. WINNER SELECTION

Within two (2) business days following the draw, the Sponsor or its designated representative will attempt to contact the selected entrants by any means available, including but not limited to any one or more of the following: (i) commenting on a post on one or more of Educators Financial Group’s social media pages; or (ii) sending a private message via one or more of Educators Financial Group’s social media pages. In the event that, for any reason, Sponsor cannot contact the selected entrant within a five (5) business days period following the first notification, the selected entrant may be disqualified and Sponsor may, at its sole discretion, proceed to a new drawing amongst all eligible Entries received to identify another potential winner who will be subject to disqualification in the same manner. The Sponsor will not be responsible for selected Participants who cannot be contacted or who do not respond in a timely manner.

Before being declared a winner and being awarded a Prize, the selected entrant may be required to do any or all of the following: (i) correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question; (ii) supply proof of age consisting of a legible photocopy of either a provincially issued driver’s license or other government issued identification; (iii) supply proof of address consisting of a legible photocopy of either a provincially issued driver’s license or other government issued identification.

The selected entrant may also be required to sign and return within five (5) business days the Sponsor’s Declaration and Release Form (the “Release Form”), which (among other things): (i) confirms compliance with these Rules and acceptance of the applicable Prize as awarded without substitution; (ii) releases Educators Financial Group and Ontario Secondary School Teachers Federation, their affiliates and advertising and promotions agencies, and each of their respective employees, officers, shareholders, representatives, directors and agents (collectively ‘Releasees’) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Contest, participation in any Contest-related activity or the acceptance, use, or misuse of any prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iii) agrees to the publication, reproduction and/or other use of his/her name, Facebook and/or Twitter username, address, voice, statements and/or photograph or other likeness, without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet.

Declining the Prize, failing to correctly answer the mathematical skill-testing question or failing to return the properly executed Release Form within the time period indicated on the Release Form will cause the Prize to be forfeited and a new winner selected in accordance with the process for the applicable Prize, as described above.

The Sponsor shall not assume any liability for lost, misdirected, delayed or destroyed prizes while in transit from the Sponsors’ premises.

The terms by which the gift cards or gift certificates may be redeemed are governed by the applicable retailer or service provider. Sponsor is not responsible for administering or ensuring compliance with the terms and conditions of the gift cards or gift certificates.

7. PRIVACY

Personal data gathered by Educators Financial Group will be used to administer this Contest. No further informational or marketing communications will be received by entrants unless entrants provide explicit permission to do so as indicated on the entry form. Please see Educators Financial Group’s Privacy Policy at educatorsfinancialgroup.ca/privacy/ for information on its policy towards maintaining the privacy and security of your information.

8. GENERAL

By entering this Contest, you agree to abide by these Official Contest Rules and Regulations and the decisions of Educators Financial Group (“Sponsor“), which are final and binding.

Sponsor reserves the right, at Sponsor’s sole discretion, to cancel, terminate, modify or suspend the Contest, in whole or in part, without notice or obligation.

Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with, or attempts to tamper with, the entry process or violates any of the Contest Rules. Any attempt to undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right, in its sole discretion, to seek damages or other remedies from any such person(s) responsible to the fullest extent permitted by law.

All decisions rendered by the Sponsor and/or its authorized representatives regarding any aspects of the Contest are final. This Contest is subject to all applicable federal, provincial and municipal laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.

9. SOCIAL MEDIA

This Contest is in no way sponsored, endorsed or administered by any social media platforms on which the Contest may have been promoted and/or publicized, including but not limited to Facebook and/or Twitter. You understand that by participating in the Contest you are providing your information to Educators Financial Group and not to Facebook/Instagram (except as otherwise specified in the Facebook and/or Twitter platform terms). You agree to completely release Facebook and/or Twitter of all liability in connection with this Contest. Any questions or comments regarding a Contest must be directed to Educators Financial Group and not to any of the social media platforms on which the Contest may have been advertised or administered.

10. WINNER’S LIST

To obtain the name of the Prize winners, available after May 17, 2021, please send a direct message to Educators Financial Group’s social media page(s). Requests must be received within four (4) weeks of the end of the Entry Period.
